General Terms of Sale

The Emmeerre S.r.l. (hereinafter also referred to as the “Seller”), with registered office in Via Giovanni Gentile 15, 76123 Andria (BT), VAT number 07850480729, sells products for bathroom, garden and home furnishing accessories. The Seller makes available some products from its network of manufacturers for distance selling (hereinafter also referred to as “Products”) through the website www.liberoshopping.eu (hereinafter the “Site”).

These General Terms of Sale apply to all sales of Products concluded remotely through the Site and regulate distance sales in accordance and in compliance with the applicable national and European legislation, including Legislative Decree no. 70/2003, Legislative Decree no. 206/2005 and subsequent amendments (hereinafter the “Consumer Code”) and the European Directive no. 2011/83/EU on consumer rights.


1. Scope of Application

1.1 Regulation and Access

1.1 These General Terms regulate the sale of the Products offered by the Seller to its Customers through the sales channels used by the latter. Before proceeding with the purchase of Products, the Customer is required to carefully read the General Terms of Sale, made available to users in the specific section of the Site called “Terms and Conditions”.

The submission of the Purchase Order to the Seller, or the purchase concluded by the Customer directly in store, presupposes the total and absolute knowledge of these General Terms of Sale and implies their full acceptance by the Customer.

If the Customer is a Consumer, once the online purchase procedure has been completed, they will print or save an electronic copy and in any case keep these General Terms of Sale, in compliance with the provisions of articles 3 and 4 of Legislative Decree 185/1999 on distance selling.

1.2 Changes to the Conditions

1.2 These Terms of Sale may be modified by the Seller at any time. Any changes will come into effect from the moment of their publication on the Site in the section “Terms and conditions”, accessible through the “Assistance” menu present in the footer of the site.

1.3 Third Party Products

1.3 These General Terms do not regulate the sale of products offered by parties other than the Seller, even in the event that the Site contains explicit references to such products through links, banners or other hyperlinks.

1.4 Privacy

1.4 For information regarding the processing of Customers’ personal data, please refer to the content available on the Site in the section “Privacy Policy”.


2. Conclusion of the Contract

2.1 Method of Conclusion

2.1 In distance and online sales, in order to conclude the purchase contract for one or more Products, the Customer must place a Purchase Order for the Products. The contract is concluded when the Customer receives from the Seller, at the email address indicated, the confirmation of the Purchase Order.

2.2 Acceptance of Terms

2.2 By submitting the Purchase Order, the Customer accepts and undertakes to comply, in their relations with the Seller, with these General Terms of Sale – including the information regarding the right of withdrawal.

2.3 Right to Refuse Orders

2.3 The Seller reserves, in any case, the right to notify the non-acceptance of Purchase Orders that are incomplete or incorrect.

2.4 Payment Terms and Termination

2.4 If the Seller does not receive the payment within 5 days following the sending of the confirmation email of the Purchase Order, the Seller will send the Customer a payment reminder email.


3. Online Purchases through the Site

3.1 Customer Requirements

3.1 Purchase Orders may be placed directly by the Customer through the Site only by persons of legal age who are not in conditions of legal incapacity.

3.2 Purchase Procedure and Registration

3.2 For purchases through the Site, in addition to what has already been stated in the previous article 2, the Customer fills in a purchase order through an electronic order form to be transmitted to the Seller electronically by following the instructions provided by the Site during the online purchase procedure; before completing the purchase, the Customer has the possibility to correct any data entry errors.

The Customer may register on the Site by entering the required data and creating login credentials. It is necessary to provide the Seller with a valid email address in order to allow the Seller to send the Customer all the information relating to the purchase order as well as the communications required by these General Terms of Sale.

3.3 Security of Credentials

3.3 The registration credentials for the Site (email address and password) must be used exclusively by the Customer and may not be transferred to third parties. The Customer undertakes to keep them secret and to ensure that no one has access to them. The Seller shall in no case be responsible for improper or abusive use of the credentials even by third parties other than the Customer.

3.4 Product Sheets and Images

3.4 The Customer will find on the Site for each product the “product sheet” indicating its description and characteristics, together with one or more representative images. The images and descriptions present in each “product sheet” reproduce as faithfully as possible the characteristics of the Products but must always be considered as indicative. For the purposes of concluding the purchase, the Customer must consider as effective only the product description contained in the purchase order and in the related confirmation email sent by the Seller.

3.5 Cart and Acceptance

3.5 To view the selected Products and their total price it is necessary to click on the cart icon. It is recommended to check the correctness of the cart contents before confirming the Purchase Order of the Products. At the time of sending the Purchase Order, the Customer also confirms that they fully know and accept these General Terms of Sale, which are referred to via link, including the information regarding the right of withdrawal referred to in the following art.11 and the Privacy Policy.

3.6 Order Cancellation

3.6 The Customer, before the shipment is made by the Seller, may cancel the order by promptly notifying customer support and contacting our operators at the number: 0883 25 72 29.


4. Product Prices

4.1 All Product prices are expressed in Euro and include VAT. Any taxes, duties and levies applicable in the destination country of the Products, where this is different from Italy, will be borne by the Customer.

4.2 The Seller reserves the right to modify Product prices at any time; however, any price changes will not be applied to Customers who have already submitted the Purchase Order to the Seller.

4.3 In the event that a product is offered through the Site at a discounted price, the full reference price on which the discount is calculated will be indicated.

4.4 At the Seller’s discretion, certain offers on Products may be reserved, even temporarily, exclusively for purchases made through the sales channels indicated from time to time by the Seller (for example exclusively online sales through the Site, or in-store sales, etc.).


5. Delivery Costs

5.1 Delivery costs are always borne by the Customer and are specifically indicated in Euro and including VAT in the purchase order and in the confirmation email sent to the Customer. Delivery costs may vary depending on the delivery method chosen and/or in relation to the payment method used and the quantity/weight of the products.

6. PAYMENT METHODS AND INVOICING

6.1 Payment by the Customer may be made in Euros using one of the payment methods indicated on the Website and listed below.

6.2 Credit Card

6.2 Credit card details (card number, cardholder, expiration date, security code) are encrypted and transmitted directly to the payment processor. The Seller never has access to and does not store the credit card details used by the Customer to pay for the Products, even if the Customer chooses to save the card, except for data relating only to the cardholder.

6.3 PayPal

6.3 Payment for Products purchased on the Website can be made via PayPal, PayPal with credit card, or PayPal Pay in 3 installments. If the Customer chooses PayPal as the payment method, they will be redirected to www.paypal.it where they can complete the payment according to the procedures governed by PayPal (https://www.paypal.com) and the terms and conditions agreed between the Customer and PayPal. Personal data entered on the PayPal website will be processed directly by PayPal and will not be transmitted or shared with the Seller.
Payment in 3 installments is available for orders up to € 2,000.00

6.4 Cash on Delivery

6.4 By choosing this method, payment is made to the courier upon delivery of the Product.
The Customer may be contacted for further order confirmation and, for orders exceeding €200.00, may be required to pay a 20% deposit using (credit card, PayPal, or bank transfer).
If the cash on delivery shipment is refused, storage and return costs may apply.

6.5 Bank Transfer

6.5 During the purchase process, you may select bank transfer as a payment method. The IBAN required to complete the transfer is available in the Payments section of the Website.

6.6 Scalapay

6.6 If you purchase with Scalapay, you will receive your order immediately and pay in 3/4 installments.
Scalapay payments in 3/4 installments are available for orders up to € 2,000.00. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., to related entities and their assignees, and you authorize such assignment.


7. Delivery of Products

7.1 For any information regarding delivery, the Customer may contact the Seller’s Customer Service, whose contacts are indicated in the “Support” area of the Site.

7.2 For the Seller, the obligation to deliver the goods is considered fulfilled upon transfer of the material availability of the goods to the subject in charge of transport/shipping.

7.3 Before finalizing the purchase, the estimated shipping date of the Products will be indicated, which may vary depending on the geographical location of the Customer and the delivery method. In the event that the Purchase Order concerns multiple Products, for which different shipping times are expected, the estimated shipping date must be considered that relating to the item whose shipment is scheduled last.

Methods and Costs

7.4 The purchased Products will be delivered via courier chosen by the Seller, to the address indicated by the Customer in the purchase order, according to the costs and terms reported during the purchase procedure. Delivery of the Products will in any case be carried out “at street level”. The Customer may request to use the “Delivery Notice” service with a supplement of 5 euros + VAT to be paid at the time of completion of the Purchase Order.

7.5 If the Order includes bulky items these may be shipped on a pallet, which will be delivered to the Customer together with the items, and the disposal of the pallet remains exclusively the responsibility and care of the Customer.

7.6 In the event that the Customer wishes the delivery to the floor service, they may request it by opening a ticket on the page Support for the calculation of the additional cost of the service.

Storage and Hold at Depot

7.7 If after 2 (two) delivery attempts by the courier it has not been possible to deliver the goods, the Seller will send a storage notice email. The Customer may collect the goods at the hold at depot within 10 days, after which the Seller will have the right to terminate the contract retaining the shipping costs.

7.8 The Seller is not responsible for failure or delay in delivery due to force majeure (strikes, exceptional weather events, etc.). The Seller will promptly inform the Customer of the occurrence of such events.

7.9 The Customer cannot choose the courier. In case of loss/damage of the Products for reasons not attributable to the Seller, if the Customer is a Consumer, Article 63 paragraph 1 of the Consumer Code applies.


8. Product Compliance

8.1 Quality Check and Acceptance

8.1 It is the Customer's responsibility to verify the condition of the delivered Products. It is the Customer’s responsibility, at the time of delivery of the goods, to check that the packaging is intact, not damaged or otherwise altered, including the sealing materials (so-called “quality check”).

Any damage and/or alteration of the packaging must be immediately reported to the courier making the delivery and, in such case, the Customer has the right to accept the goods with a “specific reservation” to be written on the courier’s DDT: Example: "package punctured", "package damaged", "package tampered", "package broken","package wet" etc.

In no case may the Customer verify the integrity of the Products contained in the packaging in the presence of the courier at the time of delivery, without prejudice to the Customer’s right to “accept with reservation”.

8.3 Complaints will not be accepted without the application of the reservation at the time of delivery.

8.4 Damage Reporting and Insurance

8.4 In the event that the product has been damaged during transport, the Customer must notify the Seller by e-mail within 24 hours, detailing the damage that the product has suffered.

Furthermore in order to benefit from the insurance included in the price, any damage must be reported within a maximum of 24h from receipt of the goods to the following address: info@liberoshopping.eu or by opening a ticket at the customer support.

9. Lack of conformity

9.1 The Products must be checked by the Customer in order to verify that they correspond to the items ordered and that they do not present defects or other lack of conformity.

9.2 Customer Rights

9.2 In the event of lack of conformity, the Customer has the right to restoration, free of charge, of the conformity of the goods through repair or replacement, or to an appropriate reduction in price or termination of the contract.

9.3 Legal Warranty and Timing

9.3 The legal conformity warranty of the goods, provided for by Articles 128 et seq. of the Consumer Code, is 24 months. For customers who do not fall within the category of “consumers”, the legal warranties provided by Italian law apply (Article 1490 and following of the Civil Code).

The lack of conformity of the product must be communicated to the Seller by contacting Customer Service at the number: 0883 25 72 29.

It is also recommended to report to the above contact any evident signs of tampering or alteration of the packaging.


10. Right of withdrawal for the Consumer

10.1 If the Customer is also a Consumer, they may exercise the right of withdrawal without any penalty and without specifying the reason by returning to the Seller all or part of the Products purchased within 14 days from the date of receipt of the goods or, in the case of multiple goods ordered through a single order and delivered separately, from the day on which the last ordered product is received.

10.2 Return Procedure

10.2 It is sufficient for the Customer to communicate to the Seller the intention to exercise the return by accessing the site https://www.liberoshopping.eu/assistenza, opening a ticket in the section “Return Procedure” and indicating for each item: order number, invoice/order date, item code, quantity and reason for the return.

10.3 In the event that a Customer purchases a customized product, the return will not be provided.

10.5 Conditions for acceptance

10.4 In order for the return to be accepted, the Products must be returned within 14 days from the communication of withdrawal in compliance with the following conditions:

  • The Products must be returned complete with all original packaging (boxes, accessories, tags, protections, etc.);
  • The Products must be accompanied by the purchase receipt;
  • The Products must not have been opened, used or damaged;
  • Any damaged products must be returned as received, without modifications or repair attempts.

10.5 Refunds and Costs

10.5 In case of withdrawal, all payments made to the Seller are refunded, except for the following costs borne by the Customer: initial shipping costs, costs for returning the goods, cash on delivery payment costs, notice costs, delivery to floor costs and assembly

The refund will be made within 14 days from receipt of the Products and after verification of their integrity. In the case of cash on delivery, the Customer must indicate the IBAN for the credit.

10.6 Transport risks for return

10.6 In the event of damage during transport for the return, the Seller will notify the Customer within 5 working days to allow them to contest the incident with the courier. The Seller is not responsible for damage, theft or loss of returned products.

10.7 Loss of the right

10.7 The right of withdrawal lapses in case of lack of original packaging, absence of integral elements (accessories, cables, manuals), damage, use or abnormal state of conservation. In this case, the Product will be returned to the Customer with the charge of shipping costs.

10.8 The provisions on the right of withdrawal apply exclusively to the Consumer and do not apply to other categories of customers (e.g. professionals with VAT number). It has the right to accept the return deducting from the total purchase amount the amount of €50.00 + VAT


11. COMPLAINTS

11.1 If you have a complaint against Emmeerre S.r.l. for a Product or service and you have not been able to resolve it through our Customer Service, you have the possibility to submit it through the ODR platform (Online Dispute Resolution), managed by the European Commission. 12. Limitation of liability

Without prejudice to the above, for the cases expressly regulated below:

12.1 The Seller is not responsible for delivery delays due to lack of supplier stock.

12.2 Within the limits of the law, the Seller declines responsibility for products not compliant with the legislation of a country other than Italy.

12.3 The Seller is not responsible for non-substantial differences between products and images/descriptions on the site.

12.4 Except in cases of willful misconduct or gross negligence, the Seller is liable only for direct and foreseeable damages, excluding liability for indirect damages or losses.

12.5 The Seller is not responsible for obligations of third parties offering commercial warranties on the site.


13. PRIVACY

13.1 The Customer can always obtain information on how the Seller processes their personal data by accessing the Privacy Policy available on the Site.

13.2 Emmeerre S.r.l. adheres to the Code of Ethics of the Italian Association for Electronic Commerce (AICEL), available at the related link: Aicel.
